PGR Requests Suspension of Parliamentary Resolution Establishing Inquiry Commission

Praia, Dec 04 (Inforpress) – The Attorney General of the Republic (PGR) has submitted a request for successive abstract review of the constitutionality of a National Assembly (AN) resolution that establishes a Parliamentary Commission of Inquiry (CPI) to investigate former MP Amadeu Fortes Oliveira.

In a statement issued Wednesday, the Public Prosecutor’s Office (MP) reported that the PGR also requested the suspension of the resolution’s effectiveness until a ruling is issued on the merits of the appeal.

According to the MP, the request is based on the fact that the resolution “blatantly violates” Article 211(7) of the Constitution, which states that “court decisions are binding on all public and private entities and prevail over those of any other authorities.”

The Public Prosecutor’s Office further argues that the parliamentary resolution is “manifestly unconstitutional” for violating the principle of separation of powers and the independence of the judiciary.
